Girl group GSWN wins their first lawsuit against their former agency, The Wave Music.
The 28th Civil Division of the Seoul Central District Court (Judge Yoon Do-Geun) decided in favor of the seven GSWN members in confirming the non-existence of their exclusive contract. The judgment will be finalized in 14 days, and the exclusive contract will be fully terminated.
The lawsuit documents revealed since February 2022, all GSWN members have been kicked out of their accommodations due to the agency halting payment for rent. By July 2022, the dance room was cleared, and all employees and managers in charge of the girl group left the company. Foreign members Miya from Japan and Soso from Taiwan were reported to have a criminal record because The Wave Music neglected to pay for their visa paperwork.
GSWN members stated, “Since our last album activity in June 2021, we have been neglected to a level where we cannot engage in entertainment activities. The exclusive contract has completely lost its effectiveness due to the failure of the management and settlement data obligations.”
The courts believe that the exclusive contract can be terminated as the trust in the relationship is broken. They also did not provide settlement data, that being the singers’ wages. In this lawsuit, the company did not respond for more than 30 days, even after receiving the complaint. Hence, the lawsuit ended without a hearing process. The decision becomes final if The Wave Music does not appeal within 14 days of receiving the judgment.
GSWN debuted in September 2018 under Kiwi Media Group. Under an agreement with their former agency, they moved to The Wave Music. Many stories of their neglect continue to circulate, including first-hand information from Producer Swin Lee not getting paid. There’s also a report of a former employee who said they weren’t paid for their overdue salary, severance pay, and four months’ worth of expenses amounting to 6.7 million KRW.
